Another request was sent to Scott Durfee at the Harris County District Attorney's office for additional records.  We are still waiting to receive the letter from Emma, along with the subpoena for Sara, who was a material witness.  Bet says neither one will be sent because they do not have them.  That is sad and another example of the piss poor work by the Harris County District Attorney's office.  And just to let everyone know, I do believe that they are past their time in getting the information to us as outlined by the Texas Public Information Act.  Guess I will have to contact the Attorney General's office again to have them contact them and make them send the information.

The Harris County District Attorney office sent a request to withhold information from us regarding the investigation into Robert's case.  We now have the AG's decision. Attorney General Decision

Harris County District Attorney Office and Harris County Sheriff's Office has been sent requests for investigative records on Robert's case.  Believe it or not, we finally got, what is supposed to be all the records.  After reviewing them all, it is EVIDENT that there was no investigation.  They took strictly the allegation of aggravated assault and convicted Robert on all the lies, no physical evidence and no witnesses.  Tapes and a letter from Emma was delivered to the Harris County District Attorney's office.  When they sent the tapes to me, there were only 5 recorded, 4 were blank.  One question I do have, what happened to the letter from Emma that Roger delivered that has the names of several names to Paula's affair with Jose?  Guess this is another question to Pat Lykos. 

Pat Lykos, the new Harris County District Attorney, was sent ANOTHER letter on January 22, 2009.  This is the third attempt to get schedule a meeting with her to bring to her attention the incompetency of her staff.  It was even brought out in the letter, the fact that they sent other people's records and had printed some of Robert's records on a doctor's stationary that has been out of business for more than ten years.  Let's see if we get a response to that question since Scott Durfee, Harris County Legal Counsel, can't, or won't, answer the question.  As you can tell from the letter dated January 13, 2009, he did not address the matter. 

Let me say something else here.  Scott Durfee sent a request to the Attorney General's office to attempt to withhold information from us, but when he sent the records where part was blacked out, he didn't black out a social security number, and it wasn't Robert's, and we did not receive the prosecutor's notes and emails as requested.  Another fine example of the "Peter Principle".

Did you notice the question regarding the doctor's stationary?  Well, if you don't believe that this could possibly happen, here is the proof!  And what about them sending copies of other people's records, sending blank tapes and then, sending several copies of many of the pages and charging for them?  I checked on this doctor and found that he had been out of business for more than ten years, so why is this doctor's stationary being used to copy Robert's records on?

This is the response received.  He never addresses the question regarding the use of the doctor's stationary.

Mr. Durfee, where is the letter from Emma?  That was not in the records received from your office.  Was it because, in the letter, it talks about Paula setting Robert up for an aggravated assault and was never investigated?  If you go to Robert's main page and pull up Emma's letter, you will see what I am talking about.  Emma, or any of the other witnesses were never interviewed.  And Rifi and Lennie talk about Precinct 4 Constable's office doing a piss poor job.  Kinda like the pot calling the kettle black, isn't it?
